Revealing All of the Damages in Birth Trauma
A family sought justice after an improper delivery maneuver during their daughter's birth caused severe brain damage and permanent physical injuries. Now six years old, she faces daily challenges, despite her twin brother having been born without complications. Given her full life expectancy, demonstrating the profound impact of these injuries was crucial for securing a favorable jury verdict.
Every Story is Unique
Unlike many birth injury cases where children are bedridden or require G-tubes, Hannah presents a unique challenge. She can walk, even run a little, but this apparent normalcy masks a severe brain injury and a debilitating brachial plexus injury that renders her left arm almost unusable.
"We needed a video to show the jury that despite her ability to perform some tasks, she faces profound, lifelong struggles – especially when attempting fundamental activities most children master effortlessly."
The contrast is stark, particularly with her twin brother, who is thriving. Hannah, tragically, is not expected to progress cognitively or academically beyond the level of a six or seven-year-old.
"Our challenge was to convey to the jury that while she might appear 'normal' at a glance, her hidden struggles profoundly impact every aspect of her life."
What LifeNow Captured
“We were very happy that the jury appreciated a lot of the elements of damages that we hoped to prove…they gave her a substantial amount of money for non-economic, which the video helped with because they could see that, while this little girl is going to grow up to be an adult, at some point she's not going to be able to do all of the things that most other people can do and someone has to take care of her.”
Case Outcome
In one of the largest medical malpractice verdicts of 2024, the Cook County jury awarded $75.8 million to Hannah and her family, awarding damages for past and future medical care, pain and suffering, and loss of earnings. This verdict will ensure she and her family receive the lifelong care she requires.
